Can a D.A. prior to a set jury trial, make a plea bargain, after one has already been offered ?

If say new info shows cause to reconsider jail time...could it stop it from going to trial?

  1. Yes.  The DA can pretty much change his mind and withdraw charges at any point in the judicial process.  He can't add new charges without due process though.


  2. Till a verdict is handed down from a judge or jury any deal can be made.

  3. Yes, the DA is pretty much in charge of plea bargaining, recommendations, etc.  He can change his mind in that regard right up until a conviction and then has a big say in recommending sentencing.
