Can a F1 visa holder marry a H1 visa holder?

I am doing my phd here and my fiance is on his h1b . working here and his parents are on a green card. Would it be a problem if we get married

  1. it wouldn't be a problem, but you will not get an immigration visa status (ie: become permanent residence through this union-yet).  i am sure his family are sponsoring your fiance through "us greencard parents sponsoring an unmarried child over 21" (category 2b)....this process takes a while (about 10 years..longer if you're from mexico and/or philipines)...but lets say his parents were sponsoring him and he marries you while a visa number is still pending, his category changes from 2b to 3 (us citizen parent sponsoring a married child).  this process might take a little longer too, b/c his status changes...

    but to answer your question, it would not be a problem if you married a h1 visa holder.  just have a plan once you're done with your studies to stay together (whether getting an h1b visa too).
