My wife (H-4) needs to travel by herself, without me (H-1).

She has a still valid visa stamp on her passport to re-enter US.

  1. Assuming the H1b visa holder has already entered the US and is in status on his visa, yes. She can't enter first, as she's your dependent and her status is based on your status.

  2. Yes she can.  She should be having valid H 4 visa stamped in her passport. On arrival at the designated airport they even will not ask any question to her.  She simply has to tell them that you are already in US. Do not worry.  Belive in HIM.  Even they will not ask any pay slips.

  3. As long as she has valid passport and visa, she is fine to travel by herself. Make sure she turn in old I-94 when leaving US and get you I-94 when entering US.

  4. Yes, as long as YOUR H1B status is valid. Make sure she has valid, up to date I-797 to show along with a valid visa and passport and she should be fine.
