Can a Mortgage Company add points and origination fee if we don't have them on our Good Faith estimate?

On our Good Faith Estimate we don't have any points and origination fees, but recently our Mortgage company has decided to add them into our loan, they said that they made a mistake. Can they do like that?

  1. Yes they can, but federal RESPA guidelines also says they must RE-DISCLOSE the updated GFE and TIL with the changes.

    The deal isn't done until you either lock or close.


  2. Yes. You do not have a contract with them and at this point the alternative is that they could refuse to give you a loan at all.
