  3. That reminds me of a very, very, very funny event I once witnessed while in Schweinfurt, FRG.

    All of the battalion officers were gone for some sort of simulator training.  Only the lowest 2LT was left behind with a memo designating him as "Commander, 5th Battalion, 15th Infantry" for the period that all the other officers would be gone.

    A mech infantry battalion is pretty big, so for morning formations they used to bring out a PA system and put it in the center of the quad.  Then all six companies would form up in a box around the edge of the quad.

    On that one special morning, while the battalion was in formation, and the "Commander" was addressing us.  The Battalion Sergeant Major walked up to the 2LT wispered something.  The 2LT responded, AND WAS PICKED UP OVER THE PA SYSTEM, with "Sergeant Major, don't you know you are supposed to be at attention when addressing an officer?"

    When a battalion is at attention, they don't make alot of noise, actually none.  But somehow, it managed to get even quieter than it had been.

    That poor 2LT spent the rest of his day of battalion command bouncing off the Sergeant Majors walls.

  4. I don't understand what you mean by "Write-up"?  Do you mean "Charge"?  The answer to that would be yes.  If the 2ndLt witnessed the SgtMaj violating rules of the UCMJ, he has an obligation to bring the offenses to the command and let them go at it from there.

    Without further specifics, I can not answer the question more fully.

    There will be many answers that I am positive that will tell you that there is no way possible andthat SgtMaj's can do whatever they want and 2ndLt's are all idiots.  May that be true?  Perhaps, but according to the letter of the law a 2ndLt outranks ALL enlisted personnel and when it comes down to it is in a "Command" position regardless.

  5. First.....not sure what you mean "write up"..... ANYONE in the military can bring charges against anyone else regardless of rank..... often it is not a smart thing to do but it is legal. Lets say you are a pvt.....and you see the 1sgt commit a crime.....you prefer charges through the commander......the commander conducts an art 32 investigation....based on that information the commander will decide if the 1sgt will be charged.....as you can guess that rarely happens

    As to an O-1 writing up an E-9..... legal and possible......but NOT advisable.....an E-9 did not get where he did by buying the right cracker jack box prize..... He not only knows how to protect himself.....he knows how to destroy the O 1's career.....

    I have witness a lot of O1's doing stupid things...... I have also seen them go down in flames.....

    There is a saying in the Green Berets....."If you want to kiss the monkey......you need to be smarter than the monkey"..... If you are going to start a war with an E-9..... you better wear armor and have a lot of ammo

  6. Gotta go with everyone else on this one.  He can, but not the best move in the book.  Had an O1 try to tell an E9  how to do his job.  O1 spent a week shadowing the E9, never allowed to say a word.

    Then we have one of hubby's troops.... E5, who had the pleasure of writing and filing a report regarding an O6.  Good fun for the E5!

Technically a O-1 outranks a E-9.  But an O-1 writing up an E-9?  It is unlikely.  I don't see it happening.  Unless the E-9 has done something to justify punitive action.  Usually it would be the E-9 barking at the O-1 for unauthorized or unserviceable uniform wear; especially if a O-1 didn't return the salute.  Or what I have witnessed, a 1st Lt tell a SgtMaj to salute him only to have him bark back at him "walk across my service stripes son!"  Technically the SgtMaj was insubordinate, but  like anyone would do anything about it.  Many senior enlisted don't listen to butter bars anyways.

  9. legally yes they can.  But the E9 better have done something outrageously stupid like steal a government vehicle in a foreign port.  and at that point, no mere Ensign is gonna have that Pleasure.. the  XO has first dibs.  

  10. In theory it can happen but it is highly unlikely to go anywhere. It depends on what the E-9 did.  Of course the military will decide who they like best and lie and coerse every way they can to get the "right" person what they want.
