Can a Used Car Dealer sell a car that has a bent frame (one that cannot get a front end alignment)?

What are the laws in Texas about selling a car with a bent frame? From a Dealer with a license? We purchased a truck that cannot get a front end alignment, due to the fact is has a bent frame. This was not disclosed at the sale of this vehicle. We did sign an "As Is" form. But nothing was noted regards the condition of the frame. What can we do. The car dealership does not want to fix the truck.

  1. Thats a tricky one.  If the vehicle is unsafe, then it should not be sold by a dealer.  So you might have some traction there.

    Your best bet is to go to the DMV professional licensing department.  Don't call, go down there.  Take your statement from the mechanic that the car is not roadworthy and file a formal complaint.  If anyone can get results, they can.  trust me, a dealer is far more afraid of the DMV than the BBB or any private attorney.  DMV can shut you down, fine you, and make sure you are not allowed to sell again.  So start with them and see if they can help.

  2. This one is going to end up in court.

    You should have never purchased a used vehicle without a full inspection.  That's on you.  But they should not be able to sell a vehicle that is not road worthy.

    Where's the Carfax report?

  3. They covered themselves with the as-is disclosure.  Not only that, you have to prove that they knowingly sold you a frame damaged car, that wasn't recorded on the title.  They may not have known, i assume you didn't have anyone check it out.  Did you run a carfax?

If you already signed a form "As is" then it is your fault for not looking over before you buying it.  They have the right to do whatever they way, especially used car.  Next time look over the vehicle and test drive it before you sign anything.  Yes, life is suck, just learn your mistake and start to move on.  Good luck
