Can a apartment complex change the pet policy without notification?

I had a cat that just passed away a week ago, I want too get another cat but my apartment complex that I live in just changed managment, now this new group is saying that there are no pets allowed, can they do this even if I paid a pet deposit,and its also on my lease saying that I can have a cat, please help I would like to know what I can do thanks

  1. An apartment complex can change their policies but they are required to give you notice and they would need you to sign a Lease Addendum or a new Lease Agreement. The laws vary in every state so it is difficult to give you a definitive answer. Try looking up your local Landlord Tenant Act Handbook. Many times, the courts have appointed individuals that advise you with Landlord Tenant Laws for free.  


  2. Does your lease say something like “Management reserves the right to change policies at any time?”  I'll bet it does somewhere in the fine print...

  3. Is there a clause in the lease that states they can change policy without notice?  That's where your answer lies.

Yes, they can change the pet policy, unless it is specifically called out in your written lease with the former management.  However, when this current lease expires, THEN they can simply refuse to renew unless you get rid of your cat.  There are no guarantees relative to being able to keep a pet once you get one.

I think you have something you can fight with.  You have it in writing, on your lease.  The only thing with a pet deposit, is it applies to the pet you had.  Usually each new pet requires a new deposit, especially if it is non-refundable.  But, if the new management put the new pet policy in writing, and posted it, or notified all the tenants in the complex in writing, you are screwed.  They can't make anyone get rid of an existing animal, but they can restrict any new pets.

  6. The new "rules" would apply only to new tenants. Also, you probably did not pay a Pet Deposit but instead paid a Pet Fee. Seems like in your case, they are not being fair. Talk to them again. Besides, your lease says you have a cat. Doesn't say "which one..."

Your state/province/country may have something called a tenant act that you can look up.  In Canada, landlords can SAY that, but they cannot enforce it.  Especially NOT if it's in your lease and you've paid a deposit.  Here, in Canada, when you renew your lease, your old lease is still in effect  because you don't sign a new document unless you WANT to.  You're just on a month to month basis so all the old rules apply.

    My suggestion would be to do a search for Landlord / tenant act or just landlord rules or something.. Google should pull up something for you.

  8. yes. all apartments communities and their owner or managers have the right to change all or any rules and regs. as they see fit or wish. but they must give you ample time to comply with the new rules and regs.
