Can a baby's mom give the baby her maiden name even if she is married by lying on the birth certificate?

we were married at the time of my sons birth and my name is on his birth certificate on the part were it ask's mothers legal last name, she put her maiden name. But her legal name at the time was my last name. So my sons last name on the birth certificate is her maiden name. can she do this . im n michigan.

  1. Whatever you put on the application for a birth certificate is what your kids name will be-not a law that makes you have either last name--just because you are married doesn't make your name legal-it is the use of the name that makes it legal!


  2. She can put any name she wants, but you can try to contest it if you want.

  3. Yeah, she can. No matter how old the mother is the baby is HERS, and what she does with it, and calls it, is her decision. Even if she had said her name was your last name, she still has the right to use whichever last name she wants.
