Can a bankruptcy be revoked or overturned?

I went through a bankruptcy last year and, since I was turning in my vehicle and needed a new one, I rushed into buying a used car that turned out to be a piece of c**p. A friend told me I should just walk away from it and let it be repo'd. Another friend told me that if I did, it could it cause my bankruptcy to be revoked or overturned. Is this true? Help!!!

  1. You don't give much information...Was the bankruptcy a chapter 7 and discharged?? Or a chapter 13 and you're paying into a plan? You can email me if you'd like for more information....What chapter did you file?? And is it discharged??? If the vehicle is a lemon, there are lemon laws....can't really help you much with the lack of info you provided...If you email with the chapter you filed, can provide you with some more info!


  2. How did you get finance if you were made bankrupt?  If you're bankrupt, you're not allowed to buy stuff on credit.  

  3. If you had bought that car before Chapter 7 bankruptcy, and had not reaffirmed it, you could have walked away from it.  But a repo for something bought after your bankruptcy will haunt you for a little over 7 years since your last payment on it, possibly 10 years after a court judgment if they go for that just before the statute of limitations runs out.

    So it is not that your bankruptcy would be overturned, but just that you cannot get totally out of new debt for at least 8 years after your last bk.
