Can a car dealership forgive mileage on a lease if you are buying a new car from them?

I am in the process of researching and buying a new car, an '08 Nissan Armada LE specifically. The lease on my current car, an '05 Titan is up in October and I am currently about 14k miles over my allowable limit.

I have been working with a local dealer over the phone and internet and have negotiated a great price for the new car and I wanted to see the probability of them dropping the mileage charge as part of the deal.

I know dealers have "dropped" it in th past by rolling it into the cost of whatever the new vehicle is but that is not what I am looking for. Has anyone ever had success with them forgiving it outight?

  5. A dealership CANNOT forgive over mileage. Only the lessor can. And if your lease is from a bank and not from Nissan Financial, that won't happen at all. You're locked in to the terms set.

    If the lease is through Nissan's own financial company and it's a closed end lease, you can get a 10 day payoff from them. The dealer can then use that figure and take your Titan in as a trade-in rather than a lease return. By using it as a trade-in, the mileage becomes a moot point. Nissan gets paid and you get the inequity of the trade rolled into a new lease on the Armada.

    BUT ... there are two very relevant points to consider before you move forward with this. Some leases have disclaimers in the contract that say you are responsible for the over milage even if you use your vehicle as a trade-in. Be sure you won't be penalized for it when you call for a 10 day pay-off.

    AND ... all captive financial lenders, such as Nissan Financial, are taking a terrible beating on their current lease returns. Their trucks and SUVs especially. So new leases are a lot more difficult to obtain. And the rates are much higher. With this in mind, Nissan may not approve your new lease based on the negative equity that must be rolled into the new deal.

    Why would dealers give away money?  They live to s***w their customers out of every penny, and all of a sudden they are going to GIVE AWAY what is their?  And legally too?
