Can a clamper (the guy who fixes it on your wheel) use physical force to prevent you from driving away ?

i.e , let me clarify - you remove it, and as you're about to move off from your parked bay, he trys to be smart and reverses his car bumper to bumper against yours - trapping you and preventing you from leaving the car park (parking lot).

Now:

a) is this action approved of under his job title ? is he allowed to do this ?

b) if not, could you take such an individual to court ? or file a serious complaint against him ?

I thought a clampers job is simply to attach the clamp on your car and have you pay the fine. Surely he can't stop you from leaving the site at all costs , thats a problem he can let the Police sort out yes ?

Some blokes get off on this kind of job, I saw a video on youtube ( 3 part series, prob filmed on a cell phone a bloody good one at that)

and i was appauled at this idiots behaviour. Notice hes got a horde of other blokes with him, this clamper, and as much as I do not endorse or respect the behaviour of the clamped dude - I honestly can't think of a single thing to praise about the clamper.

Notice how many accomplices (were they additional employees ? security guards ? beats me...tell me what you reckon folks)

this moron has to feel 'safe' and 'guarded' so he can terrorise, bully and intimidate people.

  1. I would have to agree with the first answer and that if the car is clamped then he would have the right to stop you because maybe he might be charged for this device if you try running off with it.......

  4. Parking against your car is not using physical force - It's an offence for you to remove the clamp (criminal damage), so there's no need for the clamper to have blocked your car in, as he is then causing an obstruction.

    Just watched the three clips: Unfortunately, it's not at all clear what's happening here, and the descent into chaos towards the second & third clips is not necessary - the police should have been called as soon as the van blocked the car in (I assume that's what's happening)

I gather you were on waste ground/private land ,that people use for parking,if you were and the clamper was employed by the land owner, to stop parking vehicles from using his land without permission,he is entitled to make a citizens arrest to detain you for criminal damage to the clamp and other possible offences.If the clamper was employed by your local council district,then you are also facing other offences under the local byelaws.Whilst i can sympathise with your frustration,you must know when you are parking illegally,if you don,t you should not be driving ,ignorance of the law is no defence.If you plead not guilty they will triple the fine,if you plead ignorance,they can give you the maximum.

  6. The clamper could face criminal charges for Criminal damage (to your bumper) and Threatening Behaviour.

    Write all the details down and go to the Police at once.

  10. I would imagine that if they can stop you leaving with a clamp they can stop you leaving with a vehicle.

    If you don't want to get clamped, obey the rules of the place you stop your car.
