Can a co. be sued for not returning deposit on discontinuation of services?

i had paid a fairly huge amount as deposit to a private company at the time of purchase.now i hav discontinued their services bt im nt being returnd my deposit as i had to b their customer for atleast a yr to b entitled to it bt at no point of time was i informd about this policy till i approached them for discontinuation.can legal action be taken against that co. to get back my deposit?

  1. You can sue anybody for any reason at anytime.  However the circumstances where you stand a chance to win a judgment are limited.

    I would be willing to bet that in the course of your contracting for the service you signed a document (or clicked on an "I accept") that indicated, to the satisfaction of most judges, that you accepted terms that included loss of deposit for early termination.

    If your deposit exceeds the total amount you would have to pay to complete the required full year of service, the private company should be willing to return that excess to you.  But whether you would have a chance to win a judgment for that amount (and come out ahead after attorney and court fees) would be something you would need to find out from an attorney about.
