Can a co sign on a vehicle be undone?

I co signed for a vehicle a few months before I divorced my ex husband, is there any way to un sign, or void it?

  1. Not really, The only way to get off the note is if the finance company agrees to remove you, which is highly unlikely, or to get the person to refinance the loan.

  2. If the court order shows you are not responsible for it, make copies of it and send them to the lien holder.  You may need to sign something to get removed (loan companies don't like to take names off loans, means less bodies to go after for payment).  

    Ask your lawyer how to do it.  I am constantly amazed at how lawyers don't inform their clients of these things.  I've known of 2 cases where friends of mine were told to get out of the house yet the lawyers didn't tell them about the quick claim deed to remove them from the mortgage.  Needless to say, one of them got screwed when the Ex let the house go to foreclosure (on purpose).  The other one, makes sure his Ex can pay the mortgage so it doesn't hurt his credit, and she is the one that left him!

  3. Only with the permission of the finance company - and if you did it because he has rotten credit, they aren't going to let you get off it.  

    The divorce does NOT affect the loan.  You're still going to have to pay this off, unless you can get a judge to tell him he has to refi.   And even if the judge tells him, it's really hard to get him to actually DO it - he'll need to find another cosigner.

    **That court order, is NOT going to get you off the loan.  Been there, done that.  All you can do, is go back to court,  and have the judge find him in contempt. **
