i had a collection account with the original debtor being at&t supposed from 2002 0e 2003 that was reported on my credit report by nco collection agency,i disputed it with experian months ago and it was removed.

recently it's been re-aged for 04/2008 by afni collection agency and yesterday nco financial systems inc. called me but i didn't answer but they left a automated voice message about trying to collect a debt, but didn't ask for any name but asked to be called back at a stupid number.

the item is being disputed with experian again from like a week or two ago, shouldn't they have on record that this is the same account they deleted before?

what do i need to do to be sure this doesn't happen again if experian removes it,which they should being that it's been deleted before.

isn't re-aging a debt illegal?

THANKS A LOT!

  1. It is absolutely not legal for NCO to reage your collection if it has been removed from your credit report.  However, like any law, there is always a way around it.  What it appears they did is sold it to a subsidiary company of theirs and the subsidiary is now reporting it to the agencies.  This is currently not illegal.

Experian is not obligated to prevent another agency from reporting the same debt.  Since credit bureaus make money from selling your information, they are certainly not going make any attempt to block it just because it is the same account.  There is no profit in that.  They will allow it to be placed on your reports so they can sell it to someone else.  You will have to dispute the item again and every time it shows up on your reports.  Eventually, it will not be pursued any more but until then, this is the process you are going to have to go through.

  2. sounds like the 1st company sold it to the 2nd as an outstanding debt. The 2nd compnay needs to see a letter or prooof that the 1st compnay took it off.

  3. You should check your state laws, each state has different ones. Just because the credit reporting agency deleted the debt, doesn't mean it goes away, you have to settle it with the debtor, if you did, make sure you have all the paperwork to prove it.
