Can a company report me 2 a collection agency & sue me 4 not activating & asking 2 provide a written agreement

Thesis: I technically don't have ADT's service yet so can they really report me to a collection agency and sue me??? All I want is the written agreement to compensate me if they don't provide their own service!

In March 2008 I went to a Chinese restaurant for dinner and put my name/phone in a "Free ADT Security System" box. The rep contacted me and I signed the contract (would call that the worst day of my life)!! I supposedly had 3 days to cancel. I meant to read the contract and if I didn't agree then cancel but since I was 8 months pregnant and my husband was leaving to go out of country I got very busy and didn't read the contract. I had some phone issues so they hadn't activated my service. After the phone issue were resolved I was about ready to contact them and activate my service until I casually googled "ADT monitoring service" and found this link (http://www.ripoffreport.com/reports/0/132/RipOff0132668.htm - Report #132668). Then I started doing more research and found out that many times customers were unsatisfied because through the course of time or after an unfortunate event happened they realized they weren't being monitored and ADT will not cancel the contract, refund or compensate in any form even though they were not providing service, which is what they/we are paying for. I contacted the rep and her manager to give me something in writing that if at any point I find out that I'm not being monitored that they will allow me to cancel the contract or compensate in some form. They had me call ADT corporate and they said I need to deal with my local reps. Since I'm not allowing them to activate the service without the written agreement they are frustrated and are threatening to report me to the collection agency and that the agency will sue me or the ADT local company (Webco Security, NE) will sue me. I have not received any bills and at the time of signing the contract I gave my CC # to take $149 for the equipment, which they didn't take yet and I have received no bills for any monthly service, etc. I technically don't have their service yet but have their equipment so can they really report me to a collection agency and sue me??? All I want is the written agreement.

  1.   you signed contract without reading-could there be a clause in there saying that there are times service will/could be interrupted?

      you signed legal contract now you want them to agree to your terms-too late-that should have been settled before singing

      they installed equipment-have not collected money nor billed you ?

    only information you have not giving is time span on how long ago you gave cc # to time they suppose to activate service

    T hey can send you to collections odds are they got ducks in a row to inforce payment

    this is one i would fight.

    most areas have free filing if your broke.

    and you will recover loss wages if kept

    just keep good records record calls

    most people dont have time for court and they know this

    so to get them back you keep good records end up with a day off work and will get paid for it and laugh all the way!

    you can really make this a game like they do and win
