Can a cop get a search warrant for my house?

i have a friend (an old friend) who i guess both him and his girlfriend are involved with a stolen vehicle...a guy called my house and left a message saying that he was going to contact the police so the Sheriff called said that he's going through my phone records and will come to my house with a search warrant....i have NOTHING ABSOLUTLEY NOTHING TO DO WITH THE STOLEN VEHICLE and the people they are looking for are not even at my house

  1. Probably.  What are you worried about?

    If you have something illegal put it away good, like outside, away from your place or at a friends, but all they're really looking for is stuff on this other dude, not you.  It should even say that on the warrant.  Read it.  And, remember to be nice.  Cops are like dogs, they sense fear and react to it.  Talk to yourself, saying,"this cops just doing his job like anybody else," and stay calm and cool.  Anger gets some dogs to bite.


  2. The Sheriff may be using a scare tactic against you, hoping you will provide information without a warrant. He would already have enough evidence to convince a judge you were involved to get a warrant for your phone records, and if he had that he wouldn't be calling you, and giving you a heads up that he was coming with a search warrant. They could be watching your house in hopes that if you were involved or the items were there that you or they would be concerned enough to try and move it to a new hiding place. If you have nothing to do with it, or don't know anything then you should have nothing to worry about.  

  3. There is nothing you can do to stop them if a judge grants it. The more polite you are if and when that happens, the less inconvenient it will be for you. You have nothing to hide, right?

    The "Sheriff can't go through your phone records without a warrant. That is 1st amendment "free speech" and is protected. He must have probable cause and a warrant to get them. If he did great! He can't use them or anything that came after them!

    I don't know. The government and cops think they can do just about anything they want to people. Well, a few are getting caught, like that kid on a bike who was rushed and attacked by a cop, who arrested the kid for assault on a police officer, resisting arrest and some other trumped up charge. All you need to do is look at the video to see the cop is lying through his teeth! And who gets charged. Well maybe this time the cop!

    They need a warrant...and you pray they don't have one as their search is illegal and NOTHING they find can be used!

    If they have a warrant that is a different story, however going through phone records is clearly unconstitutional!

  6. IN ORDER FOR A COP TO GET A SEARCH WARRANT THEY MUST PROVE TO A JUDGE THEY HAVE PROBABLE CAUSE TO SEARCH. THE WARRANT MUST STATE WHAT THEY ARE LOOKING FOR AND WHAT PART OF THE HOUSE. ANYTHING ELSE IS NOT ADMISSABLE BUT IF IT IS ILLEGAL YOU CAN BE CHARGED BUT IT WON'T STICK. IF THESE PEOPLE ARE NOT AT YOUR RESIDENCE INVITE THEM IN LET THEM WALK THROUGH THEN THEY CAN LEAVE. THERE IS DEFINETLY SOMETHING THAT YOU DON'T WANT THEM TO SEE SO REMOVE IT UNTIL THEIR DONE.

They can only get a search warrant to seach for what is stolen.  If you can fit a car in your house, then yes they can.  They would have to get a search warrant for the phone records too, so unless law enforcement has something reasonably linking you to the crime, you're friend is just blowing smoke up ur ***.

  9. He can get one from a Judge if he has evidence that you are involved in some way. But seeing as you have nothing to hide there should be nothing to worry about.

  10. the sherrif wants to if u have contacts with ur "friends" because u no them and the cop might think ur an accomplice

  11. A search warrant can be gotten if there is probable cause. Maybe you should go see the Sheriff in person and explain yourself to save you from a lot of headache later on.

  12. They need a court order to get your phone records and they need one to search your home and have to have something , specific they are looking for they just cant come in and look around.
