  1. They need a parent or legal guardian's consent. But in the instance that you were the suspect, there are ways that they can get around it. But only in very serious situations. Although I think that the rules change if it is just casual questioning and they are not the suspect.

Like if a child has been abused they wont ask the child in front of the perp or even parents because kids dont usually feel comfortable talking in front of someone like that or may get them in trouble.Yes they can. If your little girl will talk to them they can talk to her. A parent doesnt have to be present.

    Sure, a cop can talk to your 8 year old daughter.... in fact I hope she has been taught that when she is lost and needs help, that the police are there for her!

    Can the cop interrogate your daughter?  She has the right to counsel just as you do, and since she is a minor, she cannot say anything without your consent.  (Actually she can say anything, but it would not be admissible in court.  So if the cops have a warrant for your arrest, and ask your daughter if you are home and she says yes, they can come in and arrest you since your presence in the home is not at question, but if she said yes, you are in the basement cooking crack, they could come in and arrest you but not for cooking crack.)

    Of course there are ways around all of that.  For instance, if you and your wife are picking up strangers and murdering them in front of your daughter, or if you are raping your daughter, your daughter can be made a ward of the court, and it would be the court's decision, not yours as to whether she talks to the cops or not.

  14. It depends why. If she's lost or in similar trouble, one would hope they'd talk to her without you around! If she's the victim of, or witness to a crime, then they can also talk to her without your permission. If the cop is doing something like a safety thing at the local school, and taking questions from the students, then they can also talk to her without your permission. However, if she's a suspect in a crime, I believe they can't interrogate her without having you and/or a lawyer or her legal guardian or whoever around, especially since she's a minor.
