Can a credit card company make you pay the fee if you didnt activate the card?

I made a huge mistake. I applied for a crappy first premier credit card for people with bad credit. Mine is fine!!! They sent me a email saying (CREDIT LIMIT: 250, AVAILABLE 71.00). That difference in balance was taken out by fees!!!! ITS NOT EVEN ACTIVATED. I DONT EVEN HAVE IT!!!!

AM I OBLIGATED TO PAY THIS IF I DIDNT ACTIVATE IT!!! PLEASE HELP!!!!! IM FREAKING OUT!!!

  1. That sucks, but yeah you're obligated.

    Activating the card isn't the same as opening the account.  The card activation is just a security measure in the event that someone intercepts the card between being sent out from the company and you receiving it, to try prevent them from being able to use it.  You applied for the credit card and upon their acceptance of your application you had an open account, and now their initial fees.

Yes you are obligated to pay these fees.  You agreed on the fees when you applied for the card.  Your only hope is to check the card application carefully, and see if there is a cancellation clause.  On most of these scams there is a clause for closing the account providing you pay certain fees.

  3. Sorry, but if you applied for it sorry yes you do..that makes it a binding contract. if it was one just sent in the mail and you never applied then no..then contact the Better Business Credit Bureau about it.

  4. Generally once you apply you also agree to the fees.  However, check the terms and see if there is a provision that if you don't activate it you can just cancel.

    Try calling First Premier and see if they will cancel the card.  I have heard that they have done this in the past.  They will probably try and get you to stay and may first offer to reduce the "fees".  They may do nothing, but you can't loose anything by trying.
