Can a credit card take your primary residence in Texas?

I received a letter from a law firm stating that unless I pay the 6.500 debt I have with a credit card company they will place a judgement against me. They ask me to respond in 30 days. I recently got a 30 yr mortgage with my boyfriend for a home. The morgage is under both our names and he does not owe the debt. Can they take the home or make me sell it? Should I answer to the lawfirm?

  1. a credit card company cannot take your posessions. even if you bought them with their card.  the credit card debt sounds like it went to a collection agency and they state some crazy things. i've seen one where they were suing for 7 million dollars on a card that went delinquent for a $2000 credit line.  your credit will obviously be affected but they can't take anything from you.

But if there is a judgment then they can attach it to the home as a second and when you go to sell or refinance it will force you to pay it then---make them an offer of settlement of 50 cents on the dollar with paymen ts and send them nothing till you get an acceptance in writing and then follow the payment plan

  3. First question is how old is this debt? If you made the last payment over 4 years ago then the statute of limitations has run out, that is your defense to get it thrown out of court, you do have to show though. If it is older than that make no payments and no offers to pay. With the tight economy many places are buying old debts and try to collect, by scaring the consumer or by finding consumers that do not know their rights and doing just as these people are. First dispute the debt in writing return receipt requested, then they have to prove it is yours, and when it went delinquent, from there you either have the basis for your defense or not. If it is over 4 years, then write them and tell them the statute of limitations has expired and if they want to spend the money to take you to court and lose that is up to them, by the way you can then file suit for $1000 against them.

  4. You can call a non-profit like CCCS, and ask them to help work out a repayment plan.  They often are able to get penalties dropped, interest reduced, etc.

    NO, they can not foreclose your house.
