I filed chapter 7 bankruptcy a couple of months ago, went to court etc. Know I just received a bill from one of the old creditors? My lawyer told me that all the bills prior to my bankruptcy would be void. Can they start billing me again. All I can say is what is the point of filing bankruptcy if they can bill me again anyway..

  1. ~~If your debt to this company was discharged in bankruptcy court, then just take your discharge paper from the court, photocopy it and send it in with the bill you received. That will be the end of it.~~

  2. They can continue to bill you, and some of the scumbag creditors probably will, but they have no legal right to collect anything from you if your debts were fully discharged in bankruptcy.  If you were placed in the wage earner plan (Title 13, I think) they will eventually get some of their money from the bankruptcy trustee, but they cannot continue to harass you.

In either case, turn the bill over to the bankruptcy trustee or the court.  Let them deal with the scumbag.

My father filed Title 13 before he died, then my mother refiled to Title 7 for discharge of debts.  Dad died in 1994, Mom has been gone for seven years, and we still occasionally get letters from collection agencies addressed to them.  I just trash them now.
