Can a dead person be president under the constitution?

Is there anything in the constitution or in any federal law that says that the president must be living? Or could a dead person technically win the election and become president?

  1. A corpse is not a person.


  2. If you mean Brain dead then Obama has a chance!

  3. Once you are dead, you are no longer a citizen. The first requirement to be President is to be a citizen. So no, of course a dead person cannot run, win or serve.

  4. They have to be fit to perform the duties of the President.  So no, John McCain can't be elected.
