Can a deported spouse of a citizen return to the U.S. with a special visa or permit?

And how long does it take? Anyone have `prior experience or knowledge of this.

  1. The person would have to file a Form I-601 (Request for Waiver of Inadmissibility) and get it approved.  The request should be based on hardship.  It's very important that a knowledgeable person assist with the preparation.  It's not something I'd recommend an amateur to do.


  2. No possibility -- there is no such thing as a "special visa or permit."  There is no way this person is coming back to the US, even with voluntary departure in lieu of deportation.  He/she is barred from re-entry.

    Your spouse can apply for your immigration to his/her country.  If you have children, they have a right to citizenship in the deported parent's country of citizenship. So your spouse can get the kids passports of that country and there is no immigration hassle to take the kids.  Immigration approval is only needed for the US-citizen spouse to reunite the family in the other parent's country.

  5. good question... my husband just did a voluntary departure and my bother in law was deported... my husband just went to guadalajra, MX today and they said that he can come back to the US but he has to do some paper work first and can only come back to the US with a visa... my borher in law has just recently got a passport to come back but unfortunatly he cant get on a plane with it and he will have to do some more paper work also but it is possible with time for them to come back... im not sure yet what all has to be done but all i know is that it will be a long process... sorry im not that much help but immigration doesnt really care if they are married to a US citizen or not....

    but the ten year can be borken with prove of harships and stuff like that...

  7. if ypu have been deported and banned, you CANNOT re-enter the USA before the time period (usually 5 or 10 years) has expired. When it has passed, then your american spouse needs to petition for you legally, and apply for a waiver to allow you back in. You need to stay in the home country until you get permission to re-enter USA.

    IF you enter USA with no visa, then you are liable to be deported again and banned for life.
