Can a deportee return to the US?

I'm a US citizen & my fiance is frm Trinidad. He was deported after he served time for drug charges is there anyway he can return to the US. All of his family is in the US he had left home at the age of 7 and moved to the US with his family. Should we look to get married 1st or should we work on him getting a temporary visa? Is there any hope for him to return? Also would it help if we got letters from people in Trinidad that know him and could vouch that he turned his life around and learned from his mistakes.

  1. It sounds like your fiance is inadmissible to the U.S. for a variety of reasons. He's a previous deport. He's been convicted of a controlled substance violation. And he probably had unlawful presence, unless he was a lawful permanent resident.

    All the letters in the world probably won't help him. He is permanently barred from entering the U.S. Even marriage to a U.S. citizen isn't going to help much. His convictions cause him to be inadmissible, and in the absence of a waiver of those grounds of inadmissibility, he's not going to get a visa of any kind.

    His convictions may make him an aggravated felon, and if that's true, there's no hope at all.

I'm sorry to tell you this but your fiancee is permanently banned from entering the US.  You can attempt to obtain a waiver from the US State Dept, but its unlikely that they'll issue one to a convicted criminal.  Don't waste your time with letters, the law is pretty clear when it comes to convicted felons, there are no exceptions.  You can move to trinidad or find another fiancee.  Before you blame the US, I have 2 points to make:

    1. You're boyfriend should not have been selling drugs and the Immigration law is very clear about what happens if you are convicted of doing so.

    2. You said your boyfriend was here since 7.  Why didn't he naturalize as a US citizen?

    Be upset with your fiancee for putting yourselves in this position.

  3. No,he can't return due to the drug charges.

  4. No being convicted for drug crimes will prevent him ever being allowed to return to the US
