  1. If you have a note from the doctor saying you are to be out of work for X number of days, then no - your employer can't force you to go back to work or punish you in any way for not being able to do so.

  2. No, read the Family and Medical Leave Act, signed into law by President Bill Clinton. Not only can they not call you back on a sick note, but they can't call you back on a note that your child or spouse or immediate family member is sick. Still, that doesn't mean they have to still pay you while you're out. Whether you get paid depends on how many "sick days" you are allotted in your employment agreement. Furthermore, by "note" I take it to mean that a doctor made this out for you.

  3. No the employer is totally wrong.  Your doctor has issued a sick note to tell your employer that you are not fit enough to work.  That is why you give the sick note to your employer in the first place.  Secondly you will not be covered by any insurance if you go to work. Tell the employer that you are not fit for work and that you will return when the doctor says that you are fit enough and issues you with a signing off line.

  4. Not if a Doctor wrote it.

  5. If you mean a doctor has issued you with a certificate stating that you should not work for a specific period, then no, you are not required to work.

  6. NO. If you have been signed off you are too ill to work.

  7. No not if you have a sick certificate from your doctor.

  8. A 'sick note' is a formal notification from your doctor, recommending that you should abstain from work for a certain period of time. If you choose to ignore it and return to work, that is up to you. If your employer asks you to ignore it, they're on pretty shaky ground because that's like saying having you at work is more important than following official medical advice. Unless your doctor is your employer, they are saying they know better regarding your health. I don't know where the law stands officially, but I think any authority would take a pretty dim view of people being asked to work when they've been advised medically not to.

  9. They could ask you, but can't compel you to work or punish you for not working.

  10. Under no circumstances Should an employer call you in while your on a sick cert for Health and Safety issues. The only time you go back to work is when you receive a return back to work cert from your doctor.Your Employer can not under No Circumstances demand you to return to work.

  11. There is nothing to stop an employer to attempt to call you back on a sick note!Your rights are!You cannot be forced back into work!Until your medical practitioner says you are medically fit!
