Can a family member service you court papers or does it have to be someone in the courts?

Yes. It's called a "Special Process Server" - They have to be approved by the court. These are used when the person to be served will likely try to avoid being served. Otherwise it's via Registered Mail or Police Officer.

did u mean can a family member serve you or serve someone for u?  as far as i know, at least when i lived in NY, anyone over 18 could serve you papers....u just had to have them fill out a paper saying you served the person and where, when and how.

Usually, with most papers, service can be by any adult except a party to the action or a close relative to the party to the action.  However, that becomes an issue only if the person claims he never got served.  If he actually receives the papers it doesn't matter how he got them.

Anyone can serve you a summons.  All that is required is that the server be able to testify that they gave to you.
