Can a father ask for child support if he does not have the children physically living with him?

My ex husband has custody of our children, but our children does not physically live with him. My children live in one state (with the grandmother) and he lives in another. Can he ask for child support if the court gave his custody of children even though our children do not live with him?

We are about to go to court in a few weeks for me to regain custody of my children because he's not raising our children. How should I handle this situation.

no, but i think the grandmother can.... eeekk.. can he legally let his mother take them without consulting you first? wass that part of the parenting agreement, that he would have custody unless he feels like letting his mother raise them? i would look into the custody agreement and see if he's in contempt of something...

I would not think so, if anything the grandmother should be getting payments.  Why did you lose your children in the first place?

No he can't but the grandma can since the kids live with her!

First you need to definitively prove that he is not providing the daily care of the children. If you lost custody of your children, he can make an appeal to the court to secure child support on behalf of the person who is currently caring for the children. Good Luck on getting your children back! Ultimately, it's up to the judge.

Yes he can!!!!! He has custody of the children! Check your state that you live in!

Tell the courts that he has the custody but you would like to be the person to have custody of your children.

In many states the parent that has full placement of the children is intitled to receive child support from the other.

Send the child support to grandmother.  She's the one raising the children.

well, grandma can sue for the support he's been receiving......if grandma is his mother, I doubt she will......and yeh, you're handling it the way you should....good luck.
