Can a father stop the adoption of an unborn child?

  3. Yes.....when we adopted our son there was a lot of red tape that we had to go thru because the lawyer could not find the suspected father.

    In the state of Oregon the courts will not let an adoption go through until they have both the signature of the biological mother and the suspected father.

    If the man thinks that he is the biological father of the unborn child, he has the right to delay the adoption until DNA can be taken once the child is born.

    Note:  If the father is unknow, an adoption may be allowed, but the adopted parents should know that the father may show up later and claim is relation to the child.

They would have to wait until the baby is born and do a DNA test he needs to prove that he is the father and if he wants custody he has the right to ask the court for it because the mom wants to put the baby up for adoption. Unless the father signs a paper agreeing to waive his rights and gives consent to the adoption as well.

  5. Yes he can.  In the eyes of the law a father has the same rights as the mother.  If you want to put a child up for adoption, both parents have to be willing to relinquish their rights.  If you don't get the fathers permission the adoption can be void.

  13. Yes. The father is entitled to take custody of the baby if he wants it and the mother does not. He can then sue the mother for child support (hey, it's not a one way street.). In some cases, it's the grandparents or an aunt or uncle that would instead adopt the baby.  A much better choice in my opinion than giving the baby to strangers.

  22. Yes. If it can be proven in a court of law that he IS the biological father (DNA test after birth or mother admits so)and he wants to take full custody of the child that she is giving up. I would look into the father getting a lawyer to be on hisside- should be an open & close case because he is also almost 18. Will he be 18 by the time of birth? When it comes to adoption and giving up their child- the fatherhas just as many rights as the mother and since she cannot or will not keep it anyway- he has every right to take it. Yes, if he files the proper paperwork to try to establish paternity of the child, and files with paternity registry in the state where the baby is to be born, and is able and appropriate to parent the baby HIMSELF (not his parents, as they do not have legal rights to the baby at all in most states) and then is fond to be the biologival father through testing.    Minors are considered adults when it comes to adoption decisions in most states.

  25. Yes, he can contest the adoption. Whether he will prevail and stop the adoption is not guaranteed, but he can certainly try as it is his child too and he has father's rights.

  26. I don't know, but I can see why they would allow it. If the mother doesn't want the baby and the dad does, they would probably award custody to the dad.

  27. Unborn child, no.  Unless it's Hawaii, birth mothers can't sign away their rights until after the baby is born, sometimes having to wait up to 72 hours.  

    The birth father can sign his rights away anytime during the pregnancy.  If he does not sign away his rights, he can contest the adoption.  I recommend that he contact whatever social worker his girlfriend is working with and tell them NOW.  Otherwise, the baby will be placed and he will have to fight to get the baby from adoptive parents/ guardians who have been working for YEARS to get there.  I know he wouldn't want people to hurt, so he needs to address this NOW.

  29. Yes both biological parents have to sign for a child to be adopted. If the Father doesn’t sign his rights away, the child can’t legally be put up for adoption. If the child  was you could very likely  see a lot of legal issues. Especially if the biological father knows about the baby, and wants it.  It could turn into a mess for everybody involved and the most innocent victim would be the baby.

    I read about a mother who put her child up for adoption, for whatever reason the natural father was not notified when he found out he decided to go to court to get his boy back. Well the mother didn’t want the father to have custody of the baby so she decided to revert her decision and get him back. As birthmothers have a window of opportunity that they can change their minds.  Of course his adopted parents weren’t going to give him up with out a fight.  This custody battle lasted several years, the birth mother did get her son back. But the boy was ripped away from the only parents he had ever known at like age 3 ½ or something.
