Can a first sergeant counsel a soldier and say no contact with another soldier?

i am a soldier and my friend is a soldier and my friend he got counseled saying he would isolate himself from me and if i were to contact him he would have to tell his chain of command. can the first sergeant do that and what AR covers that?

  1. Yes, it also sounds like whom ever you are trying to contact does not want contact with you if he is going to report you. I do not know the AR for that.

  3. you are under investigation for something and he is with in his duty to his soldier to warn him to avoid guilt by association. no AR its code of conduct. you are doing something the command and his first soldier is protecting his soldier and warning him to stay away from you. stay away from him if he is your friend until you are cleared

  4. The authority that empowers a no-contact order is called "conditions on liberty."  It is a legal order.  It is covered under Rule 304 of the Manual for Courts-Martial.  

    "Conditions on liberty" are imposed by orders directing a person to do or refrain from doing specified acts. Such conditions may be imposed in conjunction with other forms of restraint or separately. A "Military Protective Order" falls under the category of "Conditions on Liberty."

    While most conditions on liberty are in writing, there is no requirement that they be so. A VERBAL ORDER IS JUST AS VALID. Quite often an authority will impose a verbal condition on liberty and follow it up with a written order when time allows.

    If I were to catch two Soldiers fighting in the barracks, I could impose a verbal condition on liberty with a follow up written order by either the 1SG or Commander.

    Like I said before, "condition on liberty" is a legal order. If a member violates the the order, you will be subject to punishment under the Uniform Code of Military Justice (UCMJ):

    Article 90, Willfully Disobeying a Superior Commissioned Officer Article 91, Willfully Disobeying the Lawful Order of a Warrant Officer, Noncommissioned Officer, or Petty Officer

    Article 92, Failure to Obey an Order or Regulation.


  5. yes they can do that, obviously you or him did something wrong to initiate this, does it really matter what the AR is, your 1SG is the highest ranking NCO in the company, and the CO probably backs his decision, there is nothing you can do about it.  


  6. It's non-judicial punishment.  If the command believes that keeping you two apart is necessary to maintain order and discipline, then yes.  He may be able to appeal the decision, but I'm willing to bet that it wouldn't do any good.  

  7. I'm sure there's something you're not telling us.  However, yes he can do that if circumstances warrant.  I'm not familiar with Army Regs, but the other services has similar options available to them.

  8. yes anyone can be given a direct order to stay away from somebody else under any circumstances.  and yes if that order is violated they can get into a lot of trouble.  

    usually enacted for harassment, undue relations/fraternization or similar reasons.  

  9. Yes he can do that it's called a no contact order...I dont think there's a AR that covers it. Its basically a the 1SG giving a lawful order.

  10. Yes. If you need clarification talk to your First Sergeant or Commander.

  11. If your 1st Sgt is in charge of your unit, your platoon or your squad.  If he is none of the above, go to your squad leader or  your platoon sgt.
