Can a husband sue a wife in small claims court?

My daughter's husband abandoned her and their baby. Now she's being sued by him in small claims court for non-existent items. It's obvious he's trying to extort money from her. I thought a community property state would prohibit this.

  1. Get a lawyer.  Check your church for someone that might be a paralegal or lawyer that might assist you. I would say it is possible but the judge will determine if it is a good lawsuit. If your daughter is correct about the non-existant items. And this should go through the divorce attornies, so the judge will probably throw it out.


  2. It depends on if the state has a community property law.  He shouldn't be able to sue unless there is a divorce.  And the items should be dealt with in the divorce.  

  3. Anyone can file a lawsuit.

    Winning is another matter...

  4. He will lose (if the court even allows him to file). He would basically be suing himself. She should be getting a divorce attorney.
