Can a insurance company garnish my wages if i was involved in a accident and had insurance but no bodily ijury

I was in a car accident in 2004 and was at fault, the other lady in the accident was paid out through her insurance company. Now 4 years later theyre trying to collect from me. I have been summoned for court, and I want to know if they will put a judgement on me and garnish my wages? At the time of the accident i had full coverage insurance but since i live in FL its a no fault state and bodily injury is not included in regular policys. If they can garish my wages could I declar bankruptcy to get rid of this? Thanks

Since you had full coverage insurance at the time of the accident, you should notify they you have been called into court on the accident.  They will furnish you with legal representation for the court case.  The chances are your insurance has already paid off on the case and has her insurance companies signature that they were satisfied with the payoff, and that will be the end of it.

    If not, and they prevail against you, they could garnishee your wages if you didn't agree to monthly payments, but that isn't likely to happen.  And no, declaring bankruptcy after the fact would not make it go away.

    garnishee (n.) A third party who has been notified that money or property in his or her hands but belonging to a defendant has been seized by legal writ.
