Can a job decline to accept doctors documentation?

saying that you are sick due to pregnancy & may need to call off due to pregnancy related issues. can they write you up for you calling off because of that & after so many write ups you get fired is that legal?

  2. Nope - they can't fire you or write you up... I was off for almost 4 months straight for severe morning sickness... they had to hold my position for me (they ended up hiring someone on contract) but once I had a doctor's note to say I was capable of coming back part-time in afternoons (after 4 months of being off) they had to accept me back into my regular position.

    You cannot be fired for pregnancy-related illness - your job is your job.

    Especially with Doctor's documentation - that would be illegal.

    no, they cannot write you up.  its a dr note.  sick days are for being sick. dr note excuse the sickness.

So much varies from state to state.  Discrimination laws exist that protect preganancy, but it is best to check with an attorney to see what exactly is covered.  For example, your job might have to hold your position for you, but is allowed to hire a temp in the meantime and not pay you when you are unable to work.  If you are a temp, you might not have protection due to the nature of your contract.  If cash is a problem, you can contact your local bar association (in the yellow pages), give them a basic explanation of the problem, and ask for a referral - attorneys who take referrals from the bar typically charge a minimal fee (such as $20) for the initial consultation, and payment for any further work is worked out at the consultation meeting.  Good luck to you - been there, done that.

  5. Pregnancy is not considered an illness nor a disability even if you have morning sickness or anything else.  They can write you up for whatever they please.  I do think it is legal for them.

If you miss days a doctors note is needed and if they happened to write you up so many times that you get fired you can take them to the labor board and file a suit against them because you had doctors documentations stating an ailment/disability. If you are put off because of your pregnancy you'll go on disability and legally they have to hold your job or one of equal pay for you for as long as the doctor puts you off.
