  1. Read the terms of your lease.  It will tell you if there is any grace period or penalties due for late payment.

    Most states have similar policys, here in oregon, after the 8th day of late rent we issue a 72 hour notice of termination, if you don't pay or move out within those 3 days we file with the court to evict you. it takes 1-2 weeks to get a court date and court ends up being at the end of the month.

    but you never want it to go that far, and never ever get an eviction on your record renting will be near impossible after that.

  4. If rent is even one day late, the landlord can send you a 14-day notice to quit, and if this is your first notice during the last 12 months he must give you at least 10 days to pay any back rent you owe.

    Even if you cannot to pay the back rent, the landlord cannot just throw your property into the street.

    In order to physically evict you, the landlord must go to court and obtain an order for eviction, and you should receive notice to appear at this hearing.

    After he gets and eviction order, the landlord may physically remove your belongings and place them into storage you (may also be responsible for the storage cost).

  6. Highly unlikely. If you had paid the rent within 3 days and landlord took you to court, the court would probably rule against them. Filing for eviction against someone 3 days late, especially if they pay after 3 days, is not reasonable.

    Now, you didn't say if there are other circumstances. Let's say you have been late every month for 6 months in a row and this is month number 7. In that case, maybe filing for eviction when you are 3 days late is perfectly reasonable, and the landlord might have a better shot of winning in court.
