Can a landlord let you out of your lease if you are not satisified with the apartment?

for example, bug (gnat) problem that still exits and pest control can not fix? Before I talk to management, I was wondering if this was even possible. I have 10 months left on my lease

  1. If the place can not be profesionally fixed/corrected of gnats, it would likely be condemed. If it's THAT bad, move. Then report your LL for being a slumlord... If he/she tries to sue you, get documents from the pest control company stating the problem can not be taken care of.

    jeeez that place must be real bad...


  2. It is possible and common.    The customary agreement is that you pay 2 months rent and can leave.     There is no law for this, by law you have another 10 months.

    Are you under a lease or a Rental Agreement? Two very different documents but sometimes people consider them the same.

    Landlords do not what tenants to leave, so talk to him/her about your issues and im sure you can meet a common ground.

    Read the terms of your lease. You and your landlord both agreed to the lease.

    It's likely that there's some language in the lease to the effect that the unit must be habitable, and properly maintained. If you can argue that the unit is not fit for habitation, then you may have grounds within the terms of your lease to terminate the lease. A lawyer would have to advise you on that.

    It'd be better to get the cooperation of the landlord in the matter.
