Can a landlord restrict visitors?

My girlfriend, who is attending college, lives alone in a one bedroom apartment, about 45 minutes away from myself. I visit her fairly regularly. I usually visit once a week, generally on the weekend, and stay for a night or two. Without any written agreement in her lease regarding visitors, can her landlord prohibit me from visiting and crashing at her place, so long as we aren't disrespecting or bothering other tenants?

  1. You better check that lease. Look for the clause that says "Disclosure of Occupants" or something along those lines. Going by the verbage on MY lease, if I have anyone in my apartment that stays here for more than 10 days in a 30 day period, I'm violating my lease becauase I'm the only LEGAL resident of my apartment. Notice it doesn't say 10 consecutive days -- it could be 10 CUMULATIVE days. Two or three days a week x 4 weeks is getting close to the limit for you and your girlfriend.

    Either you figure out a way to let her come to YOUR place (unless you're still living with your parents -- or another girlfriend), or you don't stay there every weekend.


  2. depending on the number of actual days you stay, yes. In most cases a person can visit and spend the night, but what he may be looking at is the fact that it is on a regular basis that you stay. If it is in her lease of only one person living there, and he deems you as an extra person living there, he could in some states, such as Montana, charge her double rent, or ask her to move.

If he/she restrict visitors that you have to deal with it but I guess it depends on your negotiations. The advice that I can give to you is to ask permission to your girlfriend's landlord. Tell him/her that you will stay or visit your gf every weekends.
