Can a lien holder of a vehicle report the car stolen in Florida if....?

you are past due on your payment. Still have the possession of the car, and they have been attempting to repo. And were un successful. In the state of Florida can they report the car stolen...since it is registered in my name?

  1. The lein holder can do whatever they want, they in effect own the car. ( it doesn't matter that YOU have custody of the thing...it also doesn't matter about the repo...)

    The legal owner is the lein holder, so if they report the car stolen, and you have custody, the police/sheriff's dept will pick you up and hold you responsible for stealing the car. ( it's the law...)

Actually the answer is yes.  If the repo order is out then they have exhausted all efforts to collect on the past due amount.  They have attempted on numerous occasions to contact the debtor and have been unsuccesful.  When a car is being "stashed" the lien holder will eventually contact the local law enforcement authorities to take possession of the vehicle.

    Don't worry they will not throw you in jail just take possession of the car.  I recommend that you take the car back yourself.

  4. I don't believe so, as the car hasn't exactly been stolen per se.

    If you take the car across state lines knowing they are trying to reposess it, they might be able to.

    Pay them and you won't have to worry about it.
