Can a loft w/o building regs be called a room?

We are looking at buying a house that is advertised as having three bedrooms. But one of the bedrooms is in the loft, built in 1998 and not having either building regs or planning permission. Can this be sold as a 3-bed house in this instance? Without building regs I thought it can't be included as livable space...just a fancy loft.

  1. You can call it what you like - especially if you're an estate agent.  The Home Buyer's Pack should be interesting.  With the current shortage of buyers, they might find they've got this building on their hands for a long time.

  3. You are right there, or at least that's how it used to be, not up on current regulations though.

  4. even if the loft was built  as a bedroom originally (say in a victorian property) if it does NOT have both planning permission and building regs certificates it is ILLEGAL to describe it as a bedroom - -only a loft room.

    so in this case this is a 2 bed house with a loft room.  in the current market if the room does not have both planning permission AND building regs it is likeley to not be saleable to anyone who needs a mortgage as lenders are clamping down on such things.

    its best for the owner to apply NOW for retrospective planning permission and building regs.

  5. NO,  without planning permission its a 2 bed house. The Agents could be sued under The Property Misdescriptions Act'
