Question:

Can a mistake on a ticket make it void?

Here's the story - the other day I was passing a car on a local 2 lane highway. The speed on the highway is 80km/h, the way I was taught to drive by drivers ed is that if you pass a car on a 2 lane highway you MUST get back into your lane as quickly and safely as possible. I passed the car with ease and pulled back into my lane, took my foot off the gas and was allowing the car to bring its speed back down, as most people do rather then slamming on the brakes to bring the speed back down. An O.P.P passed me and then pulled a u-turn and pulled me over. He claims I was doing 114km/h (which from me just passing a car is not all that impossible) - he wrote me a HUGE ticket for almost $300.00 and 4 demerit points - so heres the question - on my ticket he put my car down as a "2009 Chevy Cavalier" - I drive a 1997 Chevy Cavalier - is that enough to VOID the ticket????

  1. Well you did break the speed limit even though you were passing a car.  The same thing happened to my on the was to Las Vegas.  Anyways you could get the ticket thrown out if the incorect info was something like liscense plate or car make and model but the year is not something the Judge would toss the ticket for.  But go to traffic school or defensive driving class to get the points removed. Here is a good course

  2. Yes and no.. You personally going into a court of law you have no chance working this mistake into your favor.

With a lawyer MAYBE just maybe its a tuff call there.  BUT as i understand what you said the O.P.P (is that a police man?) said you were doing 114 that's what about 65MPH HOW DID HE KNOW did you ask him if that was when you were in the oncoming lane or when you were in the lane in the direction of travel?? DO the cops in your country have a radar or lazer speed detector that can give a reading as to your speed then he is traveling in the opposite direction?  Or was he sitting on the side of the road prior?/

  3. it all just depends on the judge but in your case, probably not.

i've had a friend that has a ticket dismissed when the officer wrote down the wrong speed. she was driving 48 mph and he wrote down 88 mph on a 45 speed limit zone.

  4. The best thing to do is to ask a lawyer or legal expert about it. But to me, I think it won't void your ticket. There's more info on the ticket than just the car model. There's your driver's licences number and licences plate number. These information can track you down easily. The ticket is probably recorded under your name and DL number instead of what your car looks like. The government doesn't care what the car looks like, they only care  what you did and what's you name, etc... So I don't think the ticket could be voided.

  5. I wouldn't count on it.

The main incriminating info is your drivers license number. That proves you were there. you might argue that if the officer was so tired he couldn't be sure of the car he might have misread the speed detection equipment.

  6. Not a chance , u just got caught , the thing that counts most is he has the info on u name license # and all that pay the ticket and slow down

  7. you did the deed, pay up!

  8. Nope.

The year will not make any difference, get ya wallet out ,because your going to pay.
