Question:

Can a neighbour just invite himself onto our land because the deeds give access for repairs?

Our neighbour has right of access to our garden for repairs. He has to give 7 days notice for repairs in writing. He has complied with the bare minimum. No indication of time involved or scale of work. No discussion or even mutual agreement. Is this reasonable to just baldly say he is coming with builders onto our land? It is fortunate we are here at the time but what would have been the case if we had been away. Does merely posting a note grant free access?

  1. If he comes in with out asking then he is very ignorant.  I don't know what the law says about this but your local Council should be able to give some idea or Citizen Advice or you may need to consult a solicitor, Best of Luck


  2. quit being an $&*, and let the guy repair his house as long he does not destroy anything that belongs to you. all he needs is access to his property.

  3. If he has given you the minimum notice that is all he needs to do. You say that the access is for repairs. That should be the limit of the work. If other work is started, you can challenge it's legallity.

    Other than that why worry? Repairs are normally short term and not repetative. Take dated pics of your land in case they damage anything.

  4. It all comes down to the exact wording in the deeds. If it simply says that he has access for repairs (known as an "easement") and he gives you the required notice in writing then sadly that is all he has to do. If it does not state that he has to give details then he is under no further legal obligation. However, it would have been good manners to consult with you first.
