Can a passanger in your car sue you if you stop short and they get nausia?

Tonight I was driving too friends in my car and a light turned red so I stopped short. The two passangers said that stop made them nausious. Can they sue me for stopping short?

  1. They could sue claiming your shirt made them nausous,  but could they prove it?    In that they even dreamed this threat up,   it becomes obvious you need some more intelligent friends.   Tell these Bozos "so long"!


  2. Yes. A passenger can sue you if they get nausea while riding in your car.

    Where I live they'll have to file suit at city hall, which takes maybe half a day and costs $25.

    Then they have to have you 'served', so you'll know you're being sued and come to court at the right time and day.

    Then you show up in court, and they have to show damages, or what they're getting sick cost them - in dollars. Maybe when they got out of your car they vomited and then slipped in it and fell and broke their arm. Then they might have some grounds that your inept driving cost them time off work that you should pay for, as well as for pain and suffering.

    You might be liable for their doctor bills - which could easily be $2000. If they make $50,000 a year, then being out of work for a week costs almost $1000. Pain and suffering might be another $1000.

    It's much more likely that if they did sue you and none of that stuff happened, the suit would be thrown out. You could then sue them for sueing you frivolously.

  3. I would say no. But if your in America that would be a really stupid thing to sue over and should be through out of court,but that just seems to be the cases that win the big bucks.

  5. nausea is a temporary condition.  It isn't something that could probably even be documented 10 minutes after.  Now if you sped down the highway while they begged you to stop, maybe.  If they needed to vomit but you wouldn't let them out, maybe.  Maybe you can say that you were looking out for their overall physical safety by not running into the backside of another car.  I would also probably stop driving them around... if they get nauseous then they can walk!

    Did they suffer permanent or long term debilitating injuries?

    My guess is no to all and that is what any lawyer would tell them too, a big fat NO!

  7. First, anyone in the US can sue you at any time for anything. Will they win is the question. Also, the courts routinely reject many lawsuits a day on the grounds of being frivolous.

    Secondly, the plaintiffs must prove that it was a willful or negligent act. They must also prove that it happened. It is your word against theirs.

    Thirdly, if they do sue, demand a jury. It is your right. It will be easy to anger 12 jury members with a frivolous lawsuit.

    Fourthly, counter sue for court costs, loss of employment for the time you must spend in court, and for emotional duress.

    Fifthly, drop those "friends" like the scumbags they are.

  8. Your friends are idiots.  Nausea is temporary condition.  If they filed suit, they would have to prove in a court of law that they actually suffered nausea and that your fast stop was the cause.  I'd say they don't have a case.

    Get new friends.  You're hauling their sorry butts around and they want to sue you because you did your part in not running a red light?

    Think of a good reason and then tell them you are going to counter sue them.

    They have to prove both.

    Also considering it was to comply with traffic regulation (red light) how can they complain.  They must be real A$$.

    The first day of law school, they teach you that in america, you can sue for ANY reason.  But that does NOT mean you can win.
