  1. It depends where you are. In England it is legal for a passenger to be drinking alcohol. As long as the driver does not drink there is not a problem.

  2. The only person who has a restricted alcohol limit is the person sat in the drivers seat whilst the vehicle is in motion.

If a person was sat in the passengers seat supervising a learner driver, they also would have the same alcohol restrictions.

Passengers are out to be paraletic if they wish, although it is not reccomended.

  3. If your talking about the UK, then yes no offence is being

commited as long as your 18 years of age.

  4. Driver could be questioned for it, passenger my get drunk and do something wrong to driver. Driver is wholly responsible for....

  5. Its not illegal in the UK but is inadvisable to have alcohol being consumed in the car.  It sets an atmosphere that can only end in grief so don't do it.  Happy Motoring.

  6. NO.

In NYS, you cannot even have a open container (of alcohol) in the passenger cab.  Even if the container is completely dry, the driver will be charged.

    Good Luck....

  7. It's quite legal in the U.K.

In fact although highly inadvisable, there is nothing specifically to say that the DRIVER may not have an open container of alcohol in the car, just so long as he isn't legally intoxicated (i.e. over 0.08%)
