Question:

Can a person be rearrested for a crime, and held with no bail, when the issue was resolved 9 yrs previous?

I was put on misdomeanor probation after a plee bargain, in the state of Ohio. I moved to Tn. A felony warrent was issued by the judge. I was arrested in Tn. On a fugitive from justice warrent in 2000, They held me for 17 days, Ohio never extradited me. 2008 The same county arrested me for DUI but held me without bail on the fugitive from justice warrent again. Is this legal for the same county to keep holding me over and over again, for a old warrent?

  1. Thinking this might be double jeopardy.I would obtain a good lawyer and get this mess straightened out.It is very surprising that Ohio did not extradite you.Do not understand that.Someone is in the wrong here and obviously not doing there paperwork.


  2. You need to get the Ohio probation violation resolved. Yes, as lomg as the warrent remains active you can be held as a fugitive.  Ask for the Ohio records to be expunged.

  3. I think your problem is - you said you were on a misdemeanor Probation!!! I don't think you can move to another state while on probation! Better check with an attorney!

  4. Evidently OH didn't want to pay the cost of extradition.  I don't think their arresting you for the crime, I think it's because you haven't completed your probation requirements.  You should get an atty for the DUI and he should get this all cleared up.

  6. If you hadn't violated the probation for the original crime it would have been over long ago. You need a lawyer to see if you can get the old warrant removed from your record.  

  7. the warrant was probably never removed from there system.you'll have to contact Ohio to have this resolved. Other wise it will probably happen again.Try contacting the probation officer you had, you may get some help or advice there. Good luck.PS. the answer is yes, as long as this warrant isn't resolved, If all else fails contact A lawyer.
