  1. Depends on the jurisdiction of the legal/government authority, and the nature of the accused crime.

    Anything that involves "National Security" or "Terrorism-Related Activities" becomes a carte blanche for indefinite detention.


  2. depends on the charge. if you've been charged with absolutely nothing other than being accused of being friends with someone who has ties to terrorists then you can be held in Guantanamo bay without being charged for anything. but in a normal case, you are entitled to a speedy trial. within a week you should get a preliminary hearing which will determine if you go to trial. its up to the judge their to determine whether or not their is enough, if any, evidence. but then again, that still depends on where you live....
