Can a person on L1B visa get income via a 1099 Misc?

  1. You were admitted for a specific position with a specific company.  If you are working elsewhere, you are in violation of your visa and must return to your home country.  You're barred from future employment-related visas.


  2. The only source of income that a L-1B visa alien can receive is from the employer that petitioned for him. There's no need for a L-1B to have a form 1099 Misc. when you can have a W-2 form.

    Perhaps if you had income from royalties, then you'd need one, but if you're working as an independent contractor, you're engaging in unlawful, unauthorized employment. Self employment is considered employment for immigration purposes.

    It is hard to imagine how an L-1 could legally get income from other than his/her petitioner. You certainly could not be employed by another organization or be self employed.

  3. 1099 Misc : Incom from investment of bank.

    - You can always have this income apart from toyr original W-2. Nothing is illlegal in it.

    - I am in L1-B and I am having incom under 1099 and I am declaring it to IRS since last two years.
