Can a person park a car in a handicap spot if the person stays inside the car the whole time?

I really need legitamite answers because my family (except me) went to a supermarket. My mom had just parked the car in a handicap spot with everybody still inside. A parking clerk came and gave my family a $300 ticket when they were in the car the whole entire time. She has asked if she can do it and police officers say she can. Why did this one give her a ticket? And on top of everything it's supposed to be $100 to park there with no person in the car and if they're not handicap. This is rediculous. PLEASE HELP!

  1. No It is legal for them to give you a ticket. You can not even if you leave people inside the car because you are not handicap. You are taking a spot from someone who really needs it. The fine is more of a fine because they are in there. I know because my sister did this also.Its the law. People who get license know the rule especially that.


  2. if it was up to me i wouldve hauled your whole family to jail, that is the most redicoulous question i've read on here.  if my grandma had to walk across the parking lot because of a person like you took a handicap spot, i would drag your car to middle of the parking lot with my truck and flatten all 4 tires and the cops would probably support me.

  3. Regardless how many people are still in the car, you are still not supposed to be in the handicap parking spot. So how you are asking the question is just because there are still people in the car you are not suppose to get a ticket? That is not justifiable!  It's a range of how much they can make the ticket out for and I guess the parking clerk gave the maximum amount.  The real question you should be asking is to your family is why did you park there in the first place????

  4. Was anyone in the car legally handicapped?  Does the car have legal handicap designations (license plates, mirror hanger, etc)?  Was the driver still in the car when the ticket was issued?

    If not, I don't understand why you are complaining.

    Why did your mother park in a handicapped space?  It appears she tried using the space as a "short-term parking" space and got caught breaking the law.  She might have got away with it if she had stayed in the driver's seat with the motor running so she could move immediately if a legally handicapped person needed the space, but it sounds like that wasn't the case.  

    Doesn't really matter why she did it, she broke the law.  The parking clerk might have warned her to move before issuing a ticket, but that's probably an option the clerk chose not to use.

    I have no idea why the ticket was $300 instead of $100 (assuming you are right about the amount).  The ticket should be the same amount regardless of how many people are in the car.  One car, one ticket.

  5. If you don't have handicap tags (and thus are not registered as a vehicle with handicapped passengers\driver) you can't park in a handicapped space.  Pretty simple.  Depending on what state you are in, your fine could have been a lot worse.  


  6. whether your in the car or not shouldn't make a difference... lets say a handicapped person drove up and guess what, all the handicap spots are taken by people like your mom. Now the handicapped person either has to park in a normal spot and struggle to get to the supermarket or drive home and come back later... I agree with your family getting a ticket however I do not know the exact amounts they fine you...

  7. sorry these spots are for the handicap not the lazy people..walking will do a body good and stop being all about you,there are people that are really in need of the spot your family took up and made a handicaped persons life a little harder because you parked in ther spot.. if it was me the ticket would have been $2.000.00 and then the next time your family would think twice before being so lazy..
