medical care is substandard if it falls below the standards of the community.  What that means is that no reasonable doctor or hospital would have made that same mistake.  As such, it almost always requires expert testimony.  The exceptions are few.  For instance, leaving an instrument in a patient during surgery is malpractice per se.  If you have been harmed by substandard care, you can indeed sue.
