Can a person sue a hospital for doctor neglect? What does the courts consider doctor neglect?

  1. You can sue ANYONE for ANYTHING nowadays


  2. They can sue for malpractice.

  3. medical care is substandard if it falls below the standards of the community.  What that means is that no reasonable doctor or hospital would have made that same mistake.  As such, it almost always requires expert testimony.  The exceptions are few.  For instance, leaving an instrument in a patient during surgery is malpractice per se.  If you have been harmed by substandard care, you can indeed sue.

    Malpractice cases are difficult.  If you go forward without an attorney, you are almost certain to lose.
