My friend gained his permanent residency through asylum granted since 2003. He received his green card 2 years ago. He wants to travel back to his country to visit his father who is very sick to see him one last time before die. He is very scared that he will lose his green card if he goes back to his country he fled years ago. Will he automatically lose his green if he goes back?

  1. He should. Returning shows that his asylum bid was falsely gained.

  2. No.  Once the Green Card has been granted it cannot be lost by returning to the country of origin.  You'd be surprised at how often the "threat" back "home" evaporates once the Green Card has been granted via asylum.

  3. Yes they can lose it. Immigration authorities would believe that you are lying and that you committed fraud in order to obtain a green card.

  4. It is a very good possibility. By returning to the country he fled from could show that the asylum was gotten through fraud. If he returns it will show that he is no longer in fear of returning to his home country and therefore no longer needs asylum.
