Can a person with disability have free legal access?

Can a cognitively challenged person ( one w/ mental retardation) have free legal access in the US? Can he be also treated special in litigation, in case he is the one who stands in the witness stand?

  1. if he meets financial criteria (low income) he will be eligible for free legal services

    yes-they will be assessed for competancy to testify-and hopefully the judge would admonish a lawyer who tries to treat the person un fairly


  2. Free or reduced-cost legal help is solely based on income.  Check with your local Legal Aid office.

    As far as special consideration, the lawyer representing him should make a motion for special consideration based on his mental capacity so that the judge will set parameters.
