Question:

Can a probation officer break into your house?

This is more of a technical question, because my 6 month probation will be up in a week and I haven't had any home visits. If you aren't at home and you get an unannounced visit, would the PO break in? What are the normal steps they take if no one is at home or sleeping or taking a shower? I'm sure it happens a lot, because people are out of the house most of the day.

  1. A probation officer cannot break into a house--neither would he or she want to.  Dismissal would result.

For that matter, police cannot break into your house either, unless for a very specific reason such as a crime in progress or an immediate threat to life, health, or safety.

  2. No,

they can't break into your house. That would be a dumb thing to do because someone living there might shoot & kill them.

  3. No they will not break into your residence. As far as you not being home or not answering the door for any reason. You will have the chance to explain it and you better hope your "PO" believer's your story. If he/she doesn't, he/she will violate your probation. Pretty S****y I know, but that's how it works !

  4. They have no authority like the police do.  But, even the police can't go in unless they are invited in or have a warrant.  Same for the probation officer.  If you aren't home, he can't enter unless someone lets him in.  If he can't do an unannounced visit, he should set up a "probable" time that he may or may not show up.
