Can a "Trustee" of my will be my spouse?

  1. It can be but I highly reccomend it to be a person that you trust most other than your spouse such as a good sibling, a best friend, a parent, etc.


  2. You mean an "Executor," not a Trustee, right?  ...a "Trustee" is for a "Trust," ...an "Executor" is for your "Will"...

    While they are both very similar & are considered to be "fidiciary positions",  they are different. They each control/manage different things, in different ways, etc..., depending on how you set things up while you are alive & well.

    Either way, you definately can name your spouse, to be the Executor of your Will, (&/or Trustee of your Trust, if you have one), and it is very common to do so.  

    My best advise on who to pick, would be to just make sure, as best you can, that the person you choose is someone you can fully trust, who you know will carry out your wishes & follow the law.

    You'd be suprised how many abuse their power.  Good luck! hope this helps. =)
