Can a salaried employee be docked?

My daughter's boss (in Virginia) requires that she do a certain amount of work per day, if she has a dentist appointment she needs to stay late and finish her work, even if it takes 10 hours. However, he still docks her vacation time for the time she was out of the office during work hours, even when she makes up her time and completes her work later in the day.

I am telling her this is illegal for a salaried employee. Am I correct?

  1. He probably is not supposed to do this.  But your daughter's choices aren't great.  If she likes the job, she may be willing to put up with the bad part.
